HC suspends Manipur termination orders

IMPHAL, April 4: The Gauhati High Court Imphal Bench had on March 29 suspended the order of the Principal Secretary, Finance for terminating services of all the employees appointed with effect from Apri1 1, 1999. Justice JN Sharma passed the interim verdict on a petition filed by an association of newly appointed teachers falling under the Autonomous District Council, Churachandpur. The 92 teachers of the association were appointed in June 1999 through a DPC in November 1998. The court viewed that the teachers cannot be terminated as per the order issued by the Principal Secretary on March 19 this year as they were appointed on regular basis. The petitioners should be allowed to continue in their respective services and they are entitled to receive all service benefits including pay and allowances, the court said. Advocate S Jayanta appeared in favour of the petitioners. In another case, the Court headed by Justice H Kaminikumar upheld the earlier verdict of the court, which asked the Government not to disturb six employees who are working as field assistants on ad hoc basis in the Veterinary Department till the posts are filled up on regular basis. The ruling was made on a petition filed by the six employees represented by one T Mangi. The petitioner contended that they were appointed on adhoc basis in the department in May 1999. They also joined a DPC held from June 14 to 17 of the same year for appointing 29 field assistants in the same department. Following the petition, the court had on August 22 last year asked the Government not to oust the petitioners till the posts are filled up on regular basis.
